Bidding and Tendering Law of the People’s Republic of China
Amended in accordance with the Decision on Amending the Bidding and Tendering Law of the People’s Republic of China
and the Metrology Law of the People’s Republic of China adopted at the 31st Meeting of the Standing Committee
of the Twelfth National People’s Congress on December 27, 2017
Significance for Foreign Investors. The Bidding and Tendering Law of the People’s Republic of China (the “Law”) establishes the foundational legal framework governing competitive bidding and tendering activities conducted within the territory of China. For foreign investors and international contractors, the Law is of critical importance: it mandates that certain categories of projects — including large-scale infrastructure, public utilities, and projects funded by state-owned capital or international loans — must undergo competitive bidding. The 2017 amendment modernized key provisions by eliminating government qualification approvals for bidding agencies, streamlining bidding announcement publication requirements, and strengthening enforcement mechanisms. This English translation aims to provide international stakeholders with a reliable reference for navigating China’s procurement landscape. It is an unofficial translation prepared for informational purposes only; the authoritative text remains the Chinese-language version promulgated by the National People’s Congress.
