Table of Contents
Article 1 — These Regulations are formulated for the purposes of promoting energy conservation in public institutions, improving the efficiency of energy use, and giving full play to the exemplary role of public institutions in energy conservation in the whole society.
Article 2 — These Regulations shall apply to the energy conservation of all or part of the public institutions within the territory of the People’s Republic of China that use fiscal funds. The term “public institutions” as used in these Regulations means state organs, public institutions, organizations, and other institutions that use fiscal funds in whole or in part.
Article 3 — Public institutions shall strengthen energy conservation management, adopt technically feasible, economically reasonable, environmentally and socially acceptable measures, reduce the loss and waste of energy in all links of energy consumption, and use energy more effectively and rationally.
Article 4 — The administrative department of government offices affairs under the State Council shall be responsible for promoting, guiding, coordinating, and supervising the energy conservation work of public institutions throughout the country. The administrative departments of government offices affairs under the local people’s governments at or above the county level shall be responsible for the energy conservation work of public institutions at the corresponding level, and shall guide and supervise the energy conservation work of public institutions at lower levels.
Article 5 — The administrative departments of government offices affairs under the State Council and the local people’s governments at or above the county level shall, in conjunction with the relevant departments at the same level, formulate plans for energy conservation in public institutions and incorporate them into the energy conservation plans at the corresponding level.
Article 6 — Public institutions shall designate responsible persons for energy conservation, set up energy management posts, strengthen energy measurement and statistics, and establish sound energy consumption measurement and statistical systems.
Article 7 — Public institutions shall implement an energy consumption quota management system. The standard quota for energy consumption shall be formulated by the administrative department of government offices affairs under the State Council in conjunction with the relevant departments of the State Council and shall be implemented upon the approval of the State Council.
Article 8 — Public institutions shall report their energy consumption statistics for the previous year to the administrative department of government offices affairs at the corresponding level in accordance with the prescribed content and time limit. The administrative departments of government offices affairs shall summarize the energy consumption of public institutions and report the same to the department at a higher level.
Article 9 — Public institutions shall, in accordance with State regulations, conduct energy audits, analyze and evaluate the level of energy utilization and consumption of their own units, and adopt energy conservation measures accordingly.
Article 10 — Public institutions shall adopt the following energy conservation measures in building energy conservation: implementing energy conservation design for newly built buildings and renovation and expansion of buildings; implementing energy conservation renovation of existing buildings; implementing energy-saving operation and management of building equipment systems; and promoting the application of energy-saving technologies and products in buildings.
Article 11 — Public institutions shall strengthen the management of energy consumption in official vehicles and implement the following measures: strictly controlling the staffing and use of official vehicles; purchasing low-energy-consumption and low-emission vehicles in accordance with State regulations; strictly implementing the system of retiring and scrapping vehicles; and strengthening the maintenance and repair of official vehicles to improve energy efficiency.
Article 12 — Public institutions shall strengthen the management of energy consumption of energy-using equipment and office appliances such as elevators, air conditioners, heating systems, lighting fixtures, and office equipment, and shall adopt energy-saving measures such as sub-metering and time-of-use metering.
Article 13 — Public institutions shall designate a person to be responsible for energy consumption metering and statistics, truthfully record the original data on energy consumption metering, and establish statistical ledgers. The administrative departments of government offices affairs shall establish a public institution energy consumption monitoring system to monitor the energy consumption of public institutions.
Article 14 — Where a public institution exceeds the energy consumption quota, it shall explain the reasons to the administrative department of government offices affairs at the corresponding level. Where the energy consumption quota is seriously exceeded and no corrective measures are taken, the administrative department of government offices affairs may make suggestions for handling the matter.
Article 15 — Public institutions shall strengthen energy conservation publicity and education, raise the awareness of energy conservation among their staff, and cultivate good energy use habits. Public institutions shall organize their staff to receive energy conservation training.
Article 16 — The State encourages public institutions to adopt energy management methods such as contract energy management, implement energy conservation retrofits, and improve energy utilization efficiency. Public institutions may entrust specialized energy service companies to conduct energy audits, energy conservation retrofits, and energy management.
Article 17 — The administrative departments of government offices affairs shall conduct supervision and inspection over the energy conservation of public institutions. The content of supervision and inspection includes: the establishment and implementation of the energy conservation management system; the implementation of the energy consumption quota; and the implementation of energy conservation measures.
Article 18 — The energy conservation work of public institutions shall be incorporated into the annual performance assessment. The administrative department of government offices affairs may commend and reward public institutions that have achieved outstanding results in energy conservation work.
Article 19 — Where a public institution violates these Regulations, the administrative department of government offices affairs shall order it to make corrections within a specified time limit. Where no correction is made within the time limit, a notice of criticism shall be issued, and the directly responsible person in charge and other directly responsible persons shall be subject to sanctions in accordance with the law.
Article 20 — These Regulations shall take effect as of October 1, 2008.
