Regulations on Market Supervision Administration Offices of the PRC (State Council Order No. 846) — Full English Translation (2026)

Effective: November 1, 2026


Article 1 — These Regulations are formulated for the purpose of strengthening the development and administration of market supervision administration offices, better giving play to the functions of market supervision and administration, and serving high-quality economic and social development.

Article 2 — The work of market supervision administration offices shall uphold the leadership of the Communist Party of China, adhere to a people-centered approach, and uphold lawful administration, safety assurance, and service to development.

Article 3 — A market supervision administration office is a dispatched organ of the market supervision administration department of the people’s government at the county level, and performs administrative acts in the name of the market supervision administration department of the people’s government at the county level. The market supervision administration department of the people’s government at the county level shall strengthen its leadership and administration over market supervision administration offices.

Article 4 — Market supervision administration offices shall be established according to economic regions. The establishment and adjustment of a market supervision administration office shall be proposed by the market supervision administration department of the people’s government at the county level and handled in accordance with the prescribed authority and procedures.

Article 5 — Within the scope of the duties and responsibilities of the market supervision administration department of the people’s government at the county level, a market supervision administration office shall carry out market supervision and administration work within its jurisdiction and perform the following duties:

(1) handling registration-related matters of individually-owned businesses, specialized farmer cooperatives (federations), and their branches;

(2) undertaking the daily supervision and administration of food production and business operations, the operation of pharmaceuticals, medical devices, and cosmetics, the use of special equipment, and product quality;

(3) undertaking daily supervision and administration in the fields of anti-unfair competition, advertising, pricing, and metrology;

(4) handling complaints and reports in the field of market supervision and administration, and protecting the lawful rights and interests of consumers, business entities, and others;

(5) investigating and punishing, or assisting in the investigation and punishment of, acts that violate laws, regulations, and rules concerning market supervision and administration;

(6) publicizing laws, regulations, and rules concerning market supervision and administration; and

(7) other duties such as comprehensive administrative law enforcement of market supervision and administration.

The determination and adjustment of the specific duties of a market supervision administration office shall be proposed by the market supervision administration department of the people’s government at the county level, within the scope of the duties prescribed in the preceding paragraph and according to actual circumstances, handled in accordance with the prescribed authority and procedures, and announced to the public.

Article 6 — A market supervision administration office shall establish and improve its work systems, carry out market supervision and administration activities in accordance with the provisions of relevant laws, regulations, and rules, enforce the law in a strict, standardized, fair, and civilized manner, avoid or minimize the impact on the normal production and business activities of business entities, and accept social supervision.

Article 7 — A market supervision administration office shall enhance its awareness of service, strengthen communication with business entities and consumers within its jurisdiction, make its service procedures public, and provide standardized, convenient, and efficient government services.

Article 8 — Relevant departments of the people’s government at the county level shall, within the scope of their duties, support market supervision administration offices in carrying out their work.

Article 9 — The people’s government at the county level shall establish and improve a working mechanism for incorporating market supervision administration offices into the unified command and coordination of townships and sub-districts.

A market supervision administration office shall strengthen communication and coordination with the people’s governments of townships and sub-district offices in such respects as joint supervision and administration and the handling of complaints and reports.

Article 10 — The staffing of market supervision administration offices shall meet the needs of economic and social development within their jurisdictions and the performance of their duties.

Article 11 — Staff members of market supervision administration offices shall perform their duties in accordance with the prescribed authority and procedures, and shall be clean, honest, and impartial in law enforcement.

Article 12 — The market supervision administration department of the people’s government at the county level shall, according to work needs, organize staff members of market supervision administration offices to participate in training so as to enhance their ability to perform their duties.

Article 13 — The market supervision administration department of the people’s government at the county level shall establish and improve the job responsibility system for staff members of market supervision administration offices, and shall conduct regular assessment of the staff members.

Article 14 — Market supervision administration departments shall strengthen the standardized, normalized, and professional development of market supervision administration offices. Specific measures shall be formulated by the market supervision administration department of the State Council.

Article 15 — The people’s government at the county level shall, in accordance with relevant provisions, provide support for market supervision administration offices to carry out their work, and enhance the informatization and intellectualization of supervision and administration.

Article 16 — Market supervision administration offices shall use unified and standardized signs, and staff members shall, when performing administrative law enforcement duties, dress in a standardized manner in accordance with relevant provisions.

Article 17 — Where a staff member of a market supervision administration office abuses power, neglects duty, engages in malpractice for personal gain, or commits any other act in violation of the provisions of these Regulations, disciplinary sanctions shall be imposed in accordance with the law; if a crime is constituted, criminal liability shall be pursued in accordance with the law.

Article 18 — Other dispatched organs of market supervision administration departments, such as specialized offices, teams, and stations, shall be governed by reference to the provisions of these Regulations.

Article 19 — These Regulations shall come into force on November 1, 2026. The Regulations on Administration for Industry and Commerce Offices shall be repealed simultaneously.
