Provisions on Vocational Skills Appraisal of the People’s Republic of China

Promulgated by Document No. 76 of the Ministry of Labor on July 9, 1993, and revised with the development of the vocational skills appraisal system.

Chapter I — General Provisions

Article 1 — These Provisions are formulated in accordance with the Labor Law of the People’s Republic of China and the Vocational Education Law of the People’s Republic of China for the purposes of improving the vocational skills appraisal system, enhancing the quality of workers, and promoting economic and social development.

Article 2 — For the purposes of these Provisions, “vocational skills appraisal” refers to the objective evaluation and certification of the skill level or professional qualification of a worker by an appraisal institution in accordance with the prescribed standards and procedures.

Article 3 — These Provisions shall apply to vocational skills appraisal activities within the territory of the People’s Republic of China.

Article 4 — The human resources and social security administrative departments of people’s governments at or above the county level shall be responsible for the administration and supervision of vocational skills appraisal.

Article 5 — The State shall implement a system of vocational qualification certificates. Workers may obtain corresponding vocational qualification certificates through vocational skills appraisal.


Chapter II — Vocational Skills Appraisal Institutions

Article 6 — Vocational skills appraisal institutions are institutions that undertake the specific work of conducting vocational skills appraisals for workers.

Article 7 — Vocational skills appraisal institutions shall meet the following conditions:

1. Having workplace and facilities suitable for the vocational skills appraisal work;
2. Having appraisal examination equipment and instruments necessary for the appraisal work;
3. Having qualified examiners;
4. Having sound rules and regulations.

Article 8 — The establishment of a vocational skills appraisal institution shall be subject to the examination and approval of the human resources and social security administrative department.

Article 9 — Vocational skills appraisal institutions shall conduct appraisals within the approved scope of appraisal and shall not conduct appraisals beyond the approved scope.


Chapter III — Appraisal Examiners

Article 10 — Vocational skills appraisal examiners must pass an examination and obtain the qualification certificate for examiners before they can undertake appraisal work.

Article 11 — An appraisal examiner shall meet the following conditions:

1. Having senior technical expertise or vocational skills in the relevant profession;
2. Being fair and upright and possessing good professional ethics;
3. Having passed the training and examination for appraisal examiners.

Article 12 — Appraisal examiners shall strictly comply with appraisal standards and procedures and shall be fair and impartial in conducting appraisals.

Article 13 — The qualification certificate for appraisal examiners shall be valid for three years and may be renewed upon expiration.


Chapter IV — Appraisal Procedures

Article 14 — Workers applying for vocational skills appraisal shall submit an application, identity certificates and relevant proof materials.

Article 15 — Vocational skills appraisal institutions shall, within a specified time limit of receiving the application, organize the appraisal.

Article 16 — Vocational skills appraisal shall consist of two components: a theoretical knowledge examination and an operational skills examination. Those who pass both examinations shall obtain corresponding vocational qualification certificates.

Article 17 — The results of vocational skills appraisal shall be announced within a specified time limit. Those who pass the appraisal shall be issued vocational qualification certificates.

Article 18 — Workers who are dissatisfied with the appraisal results may apply for re-examination.


Article 19 — Where a vocational skills appraisal institution conducts appraisals beyond the approved scope or issues certificates in violation of the provisions, the human resources and social security administrative department shall order correction and may impose a fine.

Article 20 — Where an appraisal examiner violates appraisal discipline, his qualification certificate shall be revoked by the human resources and social security administrative department.

Article 21 — Where a worker obtains a vocational qualification certificate by improper means, the certificate shall be revoked by the human resources and social security administrative department.


Chapter VI — Supplementary Provisions

Article 22 — The human resources and social security administrative departments of provinces, autonomous regions and municipalities directly under the Central Government may formulate implementation rules in accordance with these Provisions.

Article 23 — These Provisions shall come into force on July 9, 1993.
