Table of Contents
Article 1 — These Provisions are formulated to regulate the establishment and operation of foreign-invested professional training institutions in China, promote international cooperation in vocational education, and improve the quality of the workforce.
Article 2 — Foreign investors may establish Sino-foreign equity joint ventures or contractual joint ventures to provide vocational and professional skills training services within China. Wholly foreign-owned enterprises may be established in pilot free trade zones.
Article 3 — The establishment requires approval from the education administrative department and the commerce department. The foreign educational institution shall be legally established and have sound educational qualifications in its home country.
Article 4 — Foreign-invested training institutions shall comply with Chinese education laws and regulations. Training programs and curricula shall be filed with the education administrative department for the record.
Article 5 — Training institutions shall employ qualified instructors. Foreign instructors shall possess appropriate professional qualifications and work permits in accordance with Chinese law.
Article 6 — Training institutions shall publicly disclose fee standards and shall not engage in false advertising or fraudulent enrollment practices.
Article 7 — Certificates and diplomas issued shall comply with Chinese regulations on academic credentials and professional qualification certificates.
Article 8 — The education administrative department shall exercise supervision and conduct periodic inspections. Violations shall be subject to warnings, fines, suspension, or license revocation.
Article 9 — Training institutions involving content related to national security, ideology, or public order shall obtain additional approval from relevant authorities.
Article 10 — These Provisions shall become effective on July 1, 2004.
